Claw Machine with Masks as Prizes Under Scrutiny|娃娃機台內放口罩供夾取 品質.來源遭疑

A claw machine in Changhua was discovered to have colorful limited edition masks as prizes. In response to public concerns, the Changhua County Government says although there is no claim on the packaging these are medical-grade masks, the manufacturer still has to provide product information on the label or face a fine of up to NT$100,000.

According to the sign on the claw machine, the masks being given away as prizes in the machine are "limited edition."

The machine was placed at Yuanlin Train Station, which has a lot of foot traffic. The masks are packaged in clear plastic and bears the "Made in Taiwan" stamp. However, there is no product information on the packaging.

You don't know who manufactured (the mask). There might not be any label. I wouldn't use it.

...because we don't have any medical certification. Of course, it can't possibly be used for medical purposes. Our (mask) can be used for simple prevention and protection. It is absolutely made in Taiwan. It's not like some of those news reports (about masks made in) Mainland China or whatever.

The claw machine owner says he removed the outer packaging so consumers can see what they are getting and the outer layer is on display for everyone to see. He also says the masks are not medical-grade. The Changhua County Public Health Bureau confirms the masks are not medical-grade but says the owner is still responsible for providing product information on packaging labels.

Masks from claw machines can't be medical-grade masks. They can only be "general" masks. General masks have to comply with the Commodity Labeling Act, (and each one) has to be clearly labeled.

County officials say even if the outer packaging is displayed, every individual packet still needs a label bearing product information. The claw machine owner has been given a deadline to add labels and will face fines of up to NT$100,000 if he fails to comply.

色彩繽紛的口罩放在娃娃機裡,機台外頭寫著限量顏色,不少民眾看有彩色口罩,都躍躍欲試。

有人試了好幾次,就是夾不到,但玩家說,機台放在人來人往的員林火車站前,確實吸引不少目光。但仔細看看,口罩都是透明包裝,上頭雖然都有台灣製造的鋼印,但不少人擔心口罩品質和來源可能都有問題。

民眾表示:「它不知道從哪個廠出來的呀?說不定沒有標示,所以我不敢用。」

娃娃機台主 陳先生表示:「因為我們沒有醫療證明,當然,不可能去做醫療。我們那個(口罩)可做簡單的防護,絕對是台灣製的,不是像新聞報的,什麼是大陸的。」

台主解釋,因為想讓消費者知道內容物,才將透明包裝的口罩陳列出來,後來已將外包裝也擺出來,並強調只是一般型口罩,並非醫療級。彰化縣衛生局也前往了解,確認未標示醫療用,也未宣稱療效,就是一般商品,但台主還是應依商品標示法的規定,清楚標明商品資訊。

彰化縣府經濟暨綠能發展處商業科科長 柯紹東表示:「娃娃機販賣口罩,口罩不能是醫療性的口罩,只能是一般性的口罩。一般性的口罩,就要依照商品標示法,(每一件)來做清楚的標示。」

縣府表示,雖然業者在機台有放外盒,但還是應該,在每件商品的外包裝標明商品資訊,也要求業者限期改善,否則可依商品標示法處最重10萬元以下罰鍰。
